Veterans Disability Benefits in West Virginia
West Virginia is home to over 140,000 military veterans. The Department of Veterans Affairs (VA) shows appreciation for our brave service members by providing several benefits and services aimed at supporting them after their military service.
One prominent benefit is the Veterans Disability program, which provides monthly financial payments to West Virginia veterans with disabilities related to their military service.
In order to measure the impact of a veteran's disability, the VA has established a rating system. This system gives a score from 10% to 100% to each disability, based on its severity. The monthly financial aid a veteran can receive is dependent on this rating.
The VA typically requires a Compensation & Pension (C&P) examination for most disability claims. This medical assessment is performed by a VA doctor to determine the severity of the disability and assign it an appropriate rating.
In cases where veterans have multiple disabilities, the VA provides a rating for each disability using their Schedule for Rating Disabilities. A combined disability rating is then calculated into a single, comprehensive rating.
Eligibility Guidelines for VA Disability Benefits
Before West Virginia veterans can qualify for VA benefits, they must satisfy several requirements.
Both of these must be true:
- You have an existing condition, either physical or mental, that impacts your health, and
- Your service history includes active duty, active duty for training, or inactive duty training.
And, at least one of the following must be true:
- You incurred an injury or sickness during your military service that can be connected to your current condition. This is known as an in-service disability claim.
or
- An existing injury or illness from before your military service worsened due to your service — called a pre-service disability claim, or
- You have a disability that is associated with your active-duty service but it only manifested after your service ended. This is known as a post-service disability claim.
Detailed medical records, military reports, and any evidence linking your condition to your military service can significantly strengthen your disability claim. Keep detailed records of medical treatments, and don't hesitate to ask your medical provider for copies of these records if you don't already have them.
Your discharge status can also play a role in your eligibility. If your discharge was honorable or under honorable conditions, you're usually eligible to access most VA benefits. Ensure your discharge status is correctly recorded. Any discrepancies should be corrected as soon as possible to avoid potential issues with your benefits eligibility.
Don't underestimate the importance of mental health. Mental conditions, such as PTSD or depression, are also recognized as service-related disabilities. If you're experiencing mental health struggles, don't hesitate to seek help and apply for disability benefits. The VA understands that not all injuries are physical, and you have every right to receive support for mental health conditions.

Once your application is submitted, you typically need to wait about 3-6 months, depending on your situation. This timeframe can vary widely based on the circumstances of your claim.
Appealing a Denial
If your VA disability claim is denied, you have the right to appeal the decision. To win your appeal, you must show that your disability is linked to your military service.
Begin your appeal by submitting a Notice of Disagreement form within a year of receiving your denial notice. Include your medical records, relevant documents, and any supportive statements that link your disability to your military service.
You don't need to go through the appeal process alone. If you decide to hire an attorney, find one who specializes in veterans' law and has experience with VA disability appeals.
